One Law Partners’ Foundation Appointed as Limited Guardian for Late Lotte Chairman Shin Kyuk-Ho

On August 29, 2016, the Seoul Family Court appointed the nonprofit foundation “Sun” as the limited guardian for the late Shin Kyuk-Ho, honorary chairman of Lotte Group, under a limited guardianship ruling. The foundation was established by One Law Partners, LLC for public interest purposes and is composed of attorneys from the firm.

Appeals against the guardianship decision, including immediate and final appeals, were all dismissed, and the ruling was finalized on June 1, 2017. From that point until Chairman Shin’s passing on January 19, 2020, attorneys from One Law Partners, LLC, serving as guardianship officers within the foundation, carried out the limited guardianship duties.

In addition to standard guardianship responsibilities, they handled complex and extensive tasks such as identifying assets in Japan, valuing unlisted Japanese shares, overseeing domestic and international litigation, and supervising legal matters.

Special legal issues also arose, including whether to temporarily relocate Chairman Shin’s residence from Lotte Hotel to Lotte Tower Residence due to hotel renovations, whether the guardian’s authority included exercising shareholder rights in Lotte Group affiliates, and the validity of shareholder rights delegated by Chairman Shin to some of his children after the guardianship commenced.
